These terms apply to any work candidate that wishes to become a registered user of our website www.ewokey.com (our “site”). Please read these terms of use carefully before you register. By registering and continuing to be a registered user, you confirm that you accept these terms and that you agree to comply with them. If you do not agree to these terms, you must not use our site.

Other applicable terms

The use of our site is also governed by the following additional terms, which also apply to your use:

  • Our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using our site, you consent to such processing and you warrant that all data provided by you is accurate.
  • Our Cookie Policy, which sets out information about the cookies on our site.

Our Services

What we do

Our site is an online platform that enables employers to search for work candidates across a range of service sectors. The site is designed to give employers confidence in their selection of work candidates and provides them with the opportunity to review work candidate profiles.

In order to join our site, you will need to complete the registration process and provide all information requested by us. We will use the information in accordance with our Privacy Policy and you agree that we may also use third party referencing agencies for the purposes of verifying such information. We shall, in our sole discretion, decide whether or not your continued registration is accepted.

Once registered, you will be entitled to have a standard profile on our site.

Employers will be able to contact you directly through our site at their discretion. You may also review the employer ads and respond to them directly.  

Where you agree to undertake work for an employer, you will be responsible for agreeing terms with the employer. We shall have no involvement in that process and disclaim any liability relating to that, given that we simply provide a platform for employers to advertise and contact workers.

What we Don’t do

We do not charge you for your use of our site. We do charge the employers in accordance with their applicable terms and conditions.

Except for as provided above, we are not responsible for the facilitation or arrangement of your work for with an employer. In particular, you are responsible for ensuring you comply with any applicable visa requirements and/or any further legal and professional requirements in relation to your recruitment to the role.

You acknowledge that we do not vet all employers or the information that they provide on our site. We make no representations, warranties or guarantees, whether express or implied, in relation to the standing of employers, or that their profile information and/or other information provided by an employer is accurate, complete or up to date. Any contract of employment or similar contract for service is solely between you and the employer.

Whilst we request certain information from employers prior to them being registered on our site, in order to ensure that they are legitimate, reputable and have an appropriate level of qualifications, this does not imply our approval of those employers and we are not responsible for the accuracy of any information provided to us. You should carry out your own checks before entering into an agreement with an employer.

We do not guarantee when you will get any responses from any employers through our site.

We shall not be responsible to you for any loss or damage caused by the actions or omissions of any employer.

Your obligations

When posting your profile and other information through our site, and otherwise when using our site, you shall comply with all applicable laws, regulations, industry standards and codes of practice. We will not be liable or responsible if you break such law.

You shall not do, or omit to do, or permit to be done, any act which will or may weaken, damage or be detrimental to the reputation or goodwill associated with our brand or our business.

You shall indemnify us against all liabilities, costs, expenses, damages or losses (including any direct or indirect consequential losses, loss of profit, loss of reputation and all interest, penalties and legal and other professional costs and expenses) suffered or incurred by us arising out of or in connection with any breach by you of these terms or any terms applying to our site.

Your information

Whenever you make use of a feature that allows you to provide information to us or upload content to our site, or to make contact with other users of our site, you must comply with the content standards set out below:

Information provided by you must:

  • be true and accurate;
  • be genuinely held (where it includes opinions); and
  • comply with applicable law in the UK and in any country from which it is posted.

Information provided by you must not:    

  • contain any material which is defamatory of any person;
  • contain any material which is obscene, offensive, hateful or inflammatory;
  • promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
  • infringe any copyright, database right, trade mark or other intellectual property right of any other person;
  • be likely to deceive any person;
  • be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
  • promote any illegal activity;
  • be threatening, abusive or invade another's privacy, or cause annoyance, inconvenience or needless anxiety;
  • be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
  • give the impression that it emanates from us, if this is not the case.

You warrant that all information provided by you complies with the above standards, and you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

Any job feedback you provide to us will be considered non-confidential and non-proprietary. By providing your feedback to us you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, licence to use, store and copy that content and to distribute and make it available on our site in accordance with our terms of use.

We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of our site.

We have the right not to post any information provided by you on our site or to remove such information from our site if, in our opinion, such information does not comply with the content standards set out above.

The views expressed by users on our site do not represent our views or values.

Termination

We may, at our sole discretion, withdraw your account from our site with immediate effect and without notice where you are in breach of these terms or we have reason to believe that you may do so.

General

We shall not be liable to you as a result of any delay or failure to perform our obligations to you under your subscription due to an event outside of our reasonable control.

Nothing in these terms is intended to, or shall be deemed to, establish any partnership or joint venture between us and you, nor constitute either us or you the agent or employer of the other for any purpose. Neither us nor you shall have authority to act as agent for, or to bind, the other in any way.

Each of our rights or remedies under these terms is without prejudice to any other of our rights or remedies whether under these terms or not.

If any court or competent authority decides that any of the provisions of these terms are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

If we or you delay or do not take action to enforce our or your rights under these terms this does not prevent either we or you from taking action later.

No given third party has any right to enforce any of these terms.

Applicable law

These terms, their subject matter and formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the non-exclusive jurisdiction of the courts of England and Wales.

Changes to these terms

We may revise these terms at any time by amending this page. Please check this page from time to time to take notice of any changes we made, as they are binding on you.
